The Terms of Use apply to all sales of products and/or services to be carried out by Ingersoll Argentina within and outside the Argentine Republic. Placing an order implies the User's express acceptance of these Terms of Use. By accepting them, registering as a User, or logging in as a 'guest' you declare under oath and certify that you are 18 years of age or older. If you do not agree, do not use the Site. All information provided when operating on the Site must be accurate and truthful. Providing inaccurate or false information constitutes a serious violation of these Terms of Use. By confirming your order at the end of the transaction process, the User agrees to accept the purchased items and pay their price, completing a contract of sale with Ingersoll Argentina.

The User agrees not to access or attempt to access the Site, nor to use any of the Services by any means other than the interface provided by Ingersoll Argentina. The User also agrees not to engage in any activity that interferes with or disrupts, or has the potential to interfere with or disrupt the provision of the Site’s Services or the servers and networks connected to it. Users are strictly prohibited from violating, breaching and/or in any way affecting the normal use and security of the Site, including but not limited to: a) Accessing data not intended for that User or logging into a computer or account that the User is not authorized to access; b) Attempting to probe, scan, or test the vulnerability of a system or network or breaking security or authentication measures without proper authorization; c) Trying to interfere with the service to any User, computer, or network, including, without limitation, by sending a virus to the Site, overloading, flooding, spamming, mail bombing, or crashing the software. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper functioning of this Site or any activity conducted on this Site. Furthermore, you agree not to use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, and avatars) to navigate or search this Site, other than the search engines and search agents available on this Site and different from third-party web browsers publicly available (e.g., Mozilla Firefox, Internet Explorer, Opera, Google Chrome, among others). The User and/or guest of the Site expressly accepts and acknowledges that any act, omission, or event related to the aforementioned issues that has the potential to affect the security and/or normal development of the Site is sufficiently serious to cause Ingersoll Argentina considerable damages and losses, including but not limited to lost profits due to downtime and/or a drop in sales, damage to their brands, commercial image, loss of clientele, etc.

By registering as a User you will provide information that Ingersoll Argentina deems necessary to provide a better service. The User's personal data is collected for the purpose of carrying out Ingersoll Argentina's business operations, as well as for marketing and advertising activities. In the event that the User decides to provide their data, they expressly consent that Ingersoll Argentina may use it for operational purposes of the e-commerce system on this Site and/or on other websites belonging to Ingersoll Argentina, and even to send offers of goods or services, promotions, or advertisements. Ingersoll Argentina advises its customers to keep their data updated. This way, they will periodically receive offers and promotions tailored to their needs. Ingersoll Argentina does not request data from its customers, either by telephone or email, except in cases stipulated in the 'Order Acceptance' section. If contact is made, it is for the purpose of conducting a satisfaction survey or communicating a special promotion or benefit. The National Directorate of Personal Data Protection, the Regulatory Authority of Law No. 25.326, is authorized to handle complaints and claims regarding violations of personal data protection regulations. Prices Given that the Site is designed to allow the User to shop online without having to go to the stores, the prices of each item are those that the User would pay if visiting the stores. Although Ingersoll Argentina strives to provide accurate price information, errors may occur. In the event that an item appears on the Site at an incorrect price due to an error, Ingersoll Argentina reserves the right to correct the order by charging the current price at the time the order is prepared in the store or, alternatively, to cancel the order and refund the amounts paid by the User. In this case, the User will be notified of the error and given the option to cancel or modify the purchase of the incorrectly listed product. Promotions The promotions on the website are not necessarily the same as those offered through other sales channels used by Ingersoll Argentina, such as physical branches, telephone sales, catalogs, or others, unless expressly stated on this Site or in the advertising for each promotion. When the Site contains promotions consisting of free or discounted delivery of a product with the purchase of another, the free or discounted product will be delivered to the same location where the purchased product is dispatched. Notwithstanding the provisions of Article 34 of Law 24.240, in the event of an error between the advertised image of a product and the product purchased, the User will have the right to cancel the order within 15 calendar days from the date of delivery without receiving any observations from the User. In the event of cancellation of the order after receiving the product based on inaccuracies in the description or images of the product, the User must return the product in perfect condition, along with all its original packaging and all its accessories. The information about the characteristics of the products accessed through this Site is obtained from claims made by the manufacturer of each product. Please note that manufacturers may occasionally alter their packaging and labels, so the actual packaging of the product and accompanying materials may contain information different from that shown on the Site. These advertising inclusions are solely intended to draw the Users' attention to certain offers and do not replace the product descriptions made on the Site for the item, which the User must use to evaluate and make their online purchase.

The User is prohibited from exploiting in any way the information acquired through the Site. They may not reproduce the texts or images of advertisements for purposes other than their own personal reference. The User may terminate this contract at any time, as long as they do so for the future by avoiding the use of this Site and/or, if a Registered User, renouncing their registration by following the procedure specifically provided for this. Ingersoll Argentina may also terminate this contract at any time by validly notifying such termination to the physical or electronic addresses that the User has registered on the Site. Furthermore, Ingersoll Argentina may, without prior notice, cancel the User’s status, and consequently deny access to the Site’s Services or the ability to make purchases through this channel, if the User does not comply with any term or provision of these Terms of Use. This clause shall apply regardless of whether the User is a registered browser. Ingersoll Argentina may, at any time, temporarily or permanently shut down this Site.

Such modifications will be published on the Site, with the current version in effect at the start of each session. Since it is a website open to the general public, Ingersoll Argentina is unable to notify each customer individually, except through publication on the Site itself. If any provision of these Terms is deemed unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and the other provisions of this Agreement shall remain in full force and effect. Ingersoll Argentina's inaction with respect to a breach of this agreement by the User or others does not constitute a waiver and will not limit Ingersoll Argentina's rights with respect to such breach or any subsequent breaches. Applicable Law, Dispute Resolution, Legal Measures, and Notifications This contract will be governed by and interpreted in accordance with the laws in force in the Republic of Argentina. Any dispute related to this contract or the use of this Site by the User will be resolved by the ordinary courts of competent jurisdiction according to the legislation in force and applicable to the consumer relationship between the parties. In the event that such legislation does not specify a particular jurisdiction, the national ordinary courts in commercial matters located in (…), will have jurisdiction. This provision will apply even if the User is actually domiciled outside the limits of (…) or the Republic of Argentina, as it is understood that this location is where the present contract was executed. Unless otherwise previously agreed upon in writing and signed between the User and Ingersoll Argentina, all notifications made to Users in relation to these Terms of Use will be published on the Site and will take effect from the date of their publication.
